Daniel Rocha's family is suing the city of Austin. The lawsuit also names police officers Julie Schroeder and Don Doyle as defendants.

Schroeder was the officer who shot and killed Rocha, 18, in June 2005 during a drug investigation in Southeast Austin.

Schroeder shot Rocha in the back. She was fired late last year over the incident, even though an Internal Affairs investigation cleared her of wrongdoing.

Doyle was her partner at the time. He was suspended for a month.

The lawsuit, filed Tuesday, seeks financial damages and payment of lawyers’ fees and funeral expenses.
