Pitonyak applying for new trial in Jennifer Cave murder case
Colton Pitonyak, the man convicted of murdering Jennifer Cave, 26, is applying for a new trial.
Cave was shot to death in 2005. Her body was found shot, stabbed and partially dismembered in Pitonyak's West Campus apartment. Pitonyak was convicted of Cave's murder and sentenced to 55 years in prison.
Pitonyak's attorney said he has new evidence that Laura Hall actually confessed to the murder.
In 2007, Laura Hall was convicted of helping Pitonyak dismember Cave's body and flee with him to Mexico in August 2005. She was sentenced to five years in prison for tampering with evidence and helping cover up Cave's murder.
Pitonyak's lawyer, however, now says he has evidence that Hall confessed to shooting Cave and bragged about it.
Hall's lawyer, Joe James Sawyer, was out of town Friday and could not be reached for comment.
However, a new sentencing trial for Hall was supposed to begin Tuesday. Sawyer had said the trial has now been pushed back to August.
An appeals court ruled prosecutors withheld evidence, and the court gave Hall a new sentencing hearing.
