Hasan trial date set, military lawyers to lead case

The Army psychiatrist charged in the deadly 2009 rampage at Fort Hood says he will be represented by three military lawyers.

Maj. Nidal Hasan told a judge Wednesday he had released his civilian defense attorney.
Hasan did not enter a plea during the arraignment hearing. He is charged with 13 counts of premeditated murder and 32 counts of attempted premeditated murder.

Lead attorney John Galligan was not in court, but told The Associated Press earlier that he was stepping down temporarily. Galligan wouldn't say why, but said he was willing to “resume an active role” in the case.

"Major Hasan indicated he is satisfied with detailed counsel and desires no specific military counsel. He has released his civilian counsel, Mr. J.P. Galligan,” Fort Hood Director of Public Affairs Thomas Rheinlander said.

There is question as to what “released” means, whether Galligan was fired or stepped down on his own.

During the hearing, Hasan elected to go before an officer panel which will be voting through a secret ballot.

According to officials, two-thirds of the panel members must agree to determine guilt, and two-thirds must agree on a sentence. No one of rank junior to Hasan will be part of the panel.

The decision to impose the death penalty must be unanimous.

Hasan’s trial is set to start March 5, 2012.
