Austin City Council weighs in on Wal-Mart

The site plan for the redevelopment of Northcross Mall is 34 pages long. Even though the plan doesn't specifically mention Wal-Mart, it's there. In the plans it's called Building Four and it is 219,629-square feet.

The Super Wal-Mart would be the third-biggest retail center in Central Texas. Ikea in Round Rock and Cabela's in Kyle are the only two bigger stores, Austin City Councilman Brewster McCracken.

"This is a huge surprise that the third largest retailer in Central Texas will go on an urban road instead of a freeway," McCracken said.

The reason it's a surprise, is that developers never needed the Austin City Council's approval for the store.

"Because they are a tenant in a mall, the mall had all the permits that they need to be able to fill the space without asking for any variances, which is what they are doing," Council Member Jennifer Kim.

The city received the plans back in January, they were approved in October.

"It shows that our process has some flaws," McCracken said.

Flaws that may have been realized too late because now it doesn't look like there is much the city can do.

"State law is very clear. If all the rules are followed, then if a developer or business files for a building application and building permit, then we can not legally hold that unless their is a legal justification for that," Kim said.

And as of now it looks like Wal-Mart and the developers have dotted every "i" and crossed every "t" clearing the way for the Wal-Mart to move in.
