Hotel worker talks about Pitonyak’s trip to Mexico

Jurors heard more from the state's case against Colton Pitonyak on Thursday.

Pitonyak, 24, is on trial for murder over the death of Jennifer Cave, a 21-year-old woman who was found shot, stabbed and mutilated in Pitonyak’s West Campus apartment in August 2005.

After Cave’s death, Pitonyak and another woman, Laura Hall, 22, left Austin for Mexico. Surveillance video presented Thursday show Pitonyak and Hall crossing the border in her green Cadillac.

Hall was subpoenaed to testify in the case on Thursday. She appeared before the 147th District Court Wednesday during a hearing where the jury wasn’t present. As anticipated by the defense, she took the Fifth amendment so as not to incriminate herself.

Hall is charged with hindering apprehension, a third-degree felony, and will be tried later.

Text messages presented to the jury from Pitonyak's cell phone show that Hall texted him "Why didn't you call me?" and Pitonyak texted his mother "Going to Houston."

During Thursday's testimony before the jury, Pedro Fernandez, a hotel manager from Piedras Negras, Mexico, testified that he had befriended Pitonyak and Hall while they were staying at the Casablanca Hotel.

Fernandez said he took a picture when he invited the two over to watch TV and to drink alcohol. He said that's when they started asking questions about selling Hall's Cadillac.

Defense lawyers asked Fernandez about a trip to get cocaine that night, once again focusing their case on drugs. Fernandez denied any drugs were present.

Jurors also heard from the two U.S. Marshals who picked up Pitonyak and Hall in Eagle Pass after they had been expelled from Mexico.

U.S. Marshal Vincent Bellino said Pitonyak asked why he had been arrested, and when Bellino said “murder,” he said Pitonyak replied, "If this is for murder, I know what this is about."

U.S. Marshal Joseph Smith said Pitonyak said "I really f****d up."

The defense starts their case Friday morning. During opening statements earlier this week, Pitonyak’s attorneys said he will take the stand.
