Group plans to sue Wal-Mart's legality

Construction on the 198,000 square foot Super Wal-Mart in Northcross Mall has yet to begin, and that's how Responsible Growth for Northcross wants it to stay.

The group believes the law was not followed, and is ready to take its fight to court.

"We've found five different areas where in fact the site plan does not follow the law that's on the books," spokesperson Jason Meeker said.

The first two deal with the environmental impact; the group claims the site plan violates a plat note. The note has been around since the late 1970s and is supposed to protect Shoal Creek from pollution and flooding.

They're also claiming the site plan violates the City's tree ordinance.

The lawsuit also claims traffic and public safety laws would be violated, saying the new Wal-Mart would create more traffic, therefore increasing accidents and reducing emergency response times.

And finally, the group claims the site plan violates the city's zoning laws.

"We're confident that this is an appropriately issued permit," Assistant City Manager Laura Huffman said.

Huffman said, as far as the city is concerned, Lincoln Properties has every right to move forward with building the Super Wal-Mart.

"As long as their project is complying with the City laws and regulations they can build the project," she said.
