Court agrees to hear oral arguments in Gobert case
The Court of Criminal Appeals Wednesday agreed to consider the admissibility of a statement an Austin murder suspect gave to police back in 2003.
It stemmed from the stabbing death of 30-year-old Mel Cotton in North Austin.
Police said Milton Dwayne Gobert admitted on a recorded conversation that he stabbed Cotton and her 5-year-old son.
Cotton died from her wounds, but her son survived.
Defense attorneys said detectives illegally interviewed him and the recording shouldn't be admissible.
The Court of Criminal Appeals will now hear oral arguments in the case.
No date has been set to hear them.
