Gobert capital murder trial going to jury

By: Harlan Schmidt

Monday marked the final day of testimony in the capital murder trial of 37-year-old Milton Dwayne Gobert.

Gobert stands accused of robbing, kidnapping and stabbing 30-year-old Mel Cotton to death in Oct. 2003.

Cotton's son witnessed his mother's murder when he was just 5 years old. He was also choked and stabbed during the attack. The child, now 11 years old, took the stand last week to testify against Gobert.

Gobert's lawyers have argued that he was acting in self-defense when Mel Cotton attacked him with a knife.

During the testimony Monday, jurors heard from a crime scene expert who said the wounds on Gobert's hands were more consistent with that of someone wielding a knife, rather than defensive wounds. He also stated that the stab wounds on Cotton's son were likely not accidental.

Closing arguments in the case are expected Tuesday.

If convicted of capital murder, Gobert could face the death penalty. His sentence would then be determined during the punishment phase of the trial.
