Thursday, there were some surprising developments in the punishment phase of the capital murder trial of Milton Dwayne Gobert. Gobert was found guilty of capital murder Tuesday, for the 2003 stabbing death of 30-year-old Mel Cotton.

Before his punishment phase was set to continue Thursday, a juror received a collect phone call from the Travis County Jail. The call went to the juror’s voicemail. The judge ordered the Sheriff's Department to investigate how the jail got the juror’s phone number.

A cell phone was found in Gobert's jail cell, but police have still not connected Gobert to the phone call.

A former witness for the defense who’s also a Travis County jail officer was called to the stand Thursday.

Under oath, Tasha Lass testified that while working as a guard at the jail, she had a romantic relationship with Gobert during the trial. She also said she supplied him with the cell phone.

The jury then heard a 17 minute recorded conversation between Lass and Gobert on the phone. Lass testified under the pressure of the prosecution that she had numerous conversations with Gobert.

"I would talk to him every day about his case and at one point I wanted to talk to him after, so I got a telephone and he called the telephone and we talked," Lass said.

"What kind of telephone did you get so you could talk?" prosecutor Gary Cobb asked.

"A pay-to-go phone," Lass replied.

"And why did you get that kind of phone instead of using your regular cell phone?" Cobb asked.

"So they couldn't tell it was my number," Lass answered.

Thursday she was arrested booked into the Travis County Jail on a third degree felony charge.

This is not the first time a female corrections officer has had a relationship with Gobert. In 2007, another female guard resigned after her relationship with Gobert was discovered.

Tasha Lass was placed on administrative leave Wednesday and, Thursday she was arrested booked into the Travis County Jail on a third degree felony charge.

Lass could face 10 years in prison and a $10,000 fine. Her bond is set at $50,000.

During the punishment phase of the trial, the prosecution hopes to show that Gobert is a future threat to society inside the prison system in order to seek the death sentence.

More testimony in the punishment phase of the trial will continue Friday.
