The Texas Supreme Court ruled Friday that the Green Party can submit its certified list of candidates to the Secretary of State.

That overturns a lower court ruling in favor of the Democratic Party.

While Democrats believe using corporate dollars for a petition drive to get on the ballot violates Texas election law, the Green Party of Texas disagrees. It said petition drives are an administrative cost for third parties.

It also said it was lied to about the money's corporate source.

"We find it appalling that we were misled. We were told this was not a corporation. We turned in the signatures, and then they turned around and said, 'Oh, we really are a corporation,'" kat swift, statewide coordinator for the Green Party of Texas, said.

Now that it's known, Democratic strategist Glenn Smith would like the Green Party to seriously consider the source of the money.

"I have hopes that the Green Party may back off what it's doing here, because they're in a conspiracy with their enemies," Smith said.

Harvey Kronberg of the Quorum Report said that's unlikely.

"They're fully aware that they're considered a protest vote against the Democratic Party, that the Democratic Party is not sufficiently pure on the issues that they care about," Kronberg said.

The Green Party said it wouldn't have gone as far as using corporate money to get on the ballot, but by the time it knew where the money came from, it had already turned in the petition to the secretary of state.

"If the Democratic Party wants to pay us to go back to those 92,000 people and ask them if they still want to sign it, we'll gladly redo it," Swift said.

The Supreme Court will now decide whether using corporate money to get on the ballot was legal.
