A sitting district judge accused of withholding evidence in a recently overturned 25-year-old murder conviction is set to testify under oath Monday before attorneys representing both the defendant and the State Bar of Texas.

Ken Anderson was part of the team that tried Michael Morton in the 1987 murder trial of his wife, Christine Morton.

Anderson, now a Williamson County District Judge, has been ordered by a judge to answer questions by Morton's attorneys.

They, along with State Bar investigators, want to know how evidence handled by Anderson and Round Rock attorney Mike Davis, which cleared Morton of the crime, was never presented into trial.

Earlier this month, an appeals court declared 56-year-old Morton an innocent man after DNA evidence cleared him of the crime.
